Thank you for choosing to play Slime Rancher, Slime Rancher 2 or other video games (our “Games”) developed by Monomi Park, LLC (“Company”, “we”, “us”, or “our”). We are committed to protecting your personal information and your right to privacy. When you play our Games, you trust us with certain personal information. We take your privacy very seriously. In this privacy policy, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy policy that you do not agree with, please discontinue use of our Games.

This privacy policy applies to all information collected through our Games distributed via physical distribution and various digital download platforms, including Valve’s Steam, Humble Bundle, GOG, Sony’s PlayStation Store, Epic Game Store, Nintendo Store and Microsoft’s Xbox Store platforms (together, the “Platforms”). 

Please read this privacy policy carefully as it will help you make informed decisions about sharing your personal information with us.

1. WHAT INFORMATION DO WE COLLECT?

In Short:  Some information — such as IP address and device characteristics — may be collected automatically when you play our Games.

We automatically collect certain information when you play our Games. This information does not reveal your specific identity (like your name or contact information) but may include certain device and usage information, such as your IP address, device characteristics, such as graphics card model and manufacturer, operating system, language preferences, country, information about how and when you use our Games and other technical information. This information is primarily needed to maintain the security and operation of our Games, for our internal analytics and reporting purposes, and for bug-tracking purposes.

2. HOW DO WE USE YOUR INFORMATION?

In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Games for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

  • Our Services. We may use your information as part of our efforts to keep our Games safe and secure (for example, for fraud monitoring and prevention).

  • To enforce our terms, conditions and policies for applicable business purposes, legal reasons and contractual obligations.

  • To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.

  • To deliver services to the user. We may use your information to provide you with the requested services relating to the Games.

For other Business Purposes. We may use your information for other Business Purposes, such as data analysis, identifying usage trends, and to evaluate and improve our Games, products, and your experience. We may use and store this information in aggregated and anonymized form so that it is not associated with individual end users and does not include personal information. We will not use identifiable personal information without your consent.

3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In Short: We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations.

We may process or share data based on the following legal basis:

  • Consent: We may process your data if you have given us specific consent to use your personal information in a specific purpose.

  • Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests.

  • Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.

  • Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

  • Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

More specifically, we may need to process your data or share your personal information in the following situations:

  • Vendors, Consultants and Other Third-Party Service Providers. We may share your data with third party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: data analysis, hosting services, and bug reporting. We may allow selected third parties to use tracking technology on the Games, which will enable them to collect data about how you interact with the Games over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content in the Games and better understand activity in the Games. We do not share, sell, rent or trade any of your information with third parties for their promotional purposes.

    • Additional Details: Unity Analytics. We may use the Unity Analytics service within certain Games to better understand our players’ usage of the Games. You may opt-out of Unity’s data collection via the Unity privacy info button on the About screen within the Games.  Unity’s privacy policy, available at: https://unity3d.com/legal/privacy-policy, governs Unity’s usage of personal data collected via Unity Analytics. 

    • Additional Details: Azure PlayFab Services. We may use the Azure PlayFab Services provided by Microsoft within certain Games to better understand our players’ usage of the Games. You may opt-out of data collection by the Azure PlayFab Services via the PlayFab privacy info button on the About screen within the Games. The privacy statement for Azure PlayFab Services, available at: https://privacy.microsoft.com/en-us/privacystatement, explains how Microsoft processes personal data via Azure PlayFab Service.

    • Additional Details: Game Sight. We may use the Gamesight services within certain Games to better understand our players’ usage of the Games and the performance of our advertisements outside of the Games. You may opt-out of data collection by the Gamesight services via the Gamesight privacy info button on the About screen within the Games. The privacy statement for Gamesight services, available at: https://console.gamesight.io/privacy-policy explains how Gamesight processes personal data via the Gamesight services, and also provides instructions on how to opt-out of Gamesight data and analytics services.

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

4. HOW ARE YOUR INTERACTIONS WITH THE PLATFORM HANDLED?

In Short: If you purchase and/or license the Games via a Platform, that Platform may have access to certain information about you to be used in accordance with the Platform’s policies.

You may purchase and/or license the Games via a Platform, and that Platform may have its own policies for collection of personal information in connection with the Games.  We will use the information we receive from a Platform only for the purposes that are described in this privacy policy or that are otherwise made clear to you in the Games. Please note that we do not control, and are not responsible for, other uses of your personal information by the third party Platform. We recommend that you review the Platform privacy policy to understand how the Platform collects, uses and shares your personal information, and how you can set your privacy preferences on the Platform.

5. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. If you are accessing our Games from outside the United States, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information (see "WILL YOUR INFORMATION BE SHARED WITH ANYONE?" above), in the United States, and other countries.

If you are a resident in the European Economic Area, then these countries may not have data protection or other laws as comprehensive as those in your country. We will however take all necessary measures to protect your personal information in accordance with this privacy policy and applicable law. 

6. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). 

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Games is at your own risk. You should only access the services within a secure environment.

8. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect personal information from children under 13 years of age (or other age limiting collection of a minor’s personal information under applicable law).

By using the Games, you represent that you are of legal age to provide consent under applicable law, or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Games. If we learn that personal information from users less than 13 years of age (or other age limiting collection of a minor’s personal information under applicable law) has been collected, we will take reasonable measures to promptly delete such data from our records. 9. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: In some regions, such as the European Economic Area, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.

In some regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. To make such a request, please use the contact information listed in SECTION 12 below. We will consider and act upon any request in accordance with applicable data protection laws.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal.

If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. 10. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding your personal information. The California Shine the Light law, Privacy Rights for California Minors in a Digital World law and CCPA provide California residents with certain rights regarding the processing of their personal data. 

  • Shine the Light. California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided in SECTION 12 below.

  • Privacy Rights for California Minors in a Digital World. California Business and Professions Code Section 22581 (“California Privacy Rights for Minor Users”) permits you, if you are a California resident under the age of 18, to view, correct or remove information provided by you or publicly posted by you. For inquiries regarding our disclosure policy, please contact us as described in SECTION 12 below. Requests must include “California Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and ZIP code. Any enquiries from underage users will be deleted upon completion.

  • CCPA. If you are a California resident, you have the following rights under the California Consumer Privacy Act of 2018 (“CCPA”). For purposes of this section for California residents, unless a different definition is noted, "Personal Information" has the definition given in the CCPA. 

    • Information Request. You can request the following information about how we have collected and used your Personal Information during the past 12 months:

      • The categories of Personal Information we have collected.

      • The categories of sources from which we collected the Personal Information.

      • The business or commercial purpose for collecting and/or selling Personal Information.

      • The categories of third parties with whom we share the Personal Information.

      • The categories of Personal Information that we sold or disclosed for a business purpose.

      • The categories of third parties to whom the Personal Information was sold or disclosed for a business purpose.

    • Access. You can request a copy of the Personal Information that we have collected about you during the past 12 months.

    • Deletion. You can ask us to delete the Personal Information that we have collected from you.

    • How to Exercise Your Rights

      • If you are a California resident, you may submit a request to exercise your information, access, and deletion rights by emailing privacy@monomipark.com.

      • You also have the right to opt-out of the “sale” of your Personal Information. We do not sell your Personal Information, so there is no action to opt out of. 

      • These rights are not absolute, and in some instances, we may decline your request as permitted by law. We will need to verify your identity to process your information, access, and deletion requests and reserve the right to confirm your California residency. To verify your identity, we may require you to log into your account (if applicable), provide government identification, give a declaration as to your identity under penalty of perjury, and/or provide additional information.

      • Your authorized agent may make a request on your behalf upon our verification of the agent's identity and our receipt of a copy of the valid power of attorney given to your authorized agent pursuant to California Probate Code Sections 4000-4465. If you have not provided your agent with such a power of attorney, you must provide your agent with written and signed permission to exercise your CCPA rights on your behalf, provide the information we request to verify your identity and provide us with written confirmation that you have given the authorized agent permission to submit the request.

    • You are entitled to exercise the rights described above free from discrimination as prohibited by the CCPA. 

  • Our Personal Information Collection and Use Practices. The categories of Personal Information we collect are described below by reference to the statutory categories of Personal Information specified in the CCPA (California Civil Code section 1798.140).

    • What we collect. 

      • Identifiers, such as name, email address, IP address, device ID and other online identifiers.

      • California customer records (as defined in California Civil Code § 1798.80), such as contact details and communications we collect through our support channels, marketing webpages, social media, at our events, and connected with our other marketing activities.

      • Commercial information, such as billing and transaction information and purchase history.

      • Internet or network activity information, such as information generated from interactions with our Games and websites, such as data collected through server logs and cookies and similar technologies.

      • Inferences that we derive from the preceding or other information we collect.

      • Information you voluntarily provide to us, such as in free-form webforms, may contain other categories of Personal Information not described above.

    • Sources. Internet/network activity information, IP address, and other online identifiers are collected automatically through your use of our Games and online services.

    • Disclosures to third parties for business purposes. We describe the categories of third parties to whom we disclose Personal Information described above for business purposes in the section of our Privacy Policy entitled “3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?”.

    • Business/commercial purposes for use. We describe the business and commercial purposes for which we use the Personal Information described above in the section of our Privacy Policy entitled “2. HOW DO WE USE YOUR INFORMATION?”.

11. DO WE MAKE UPDATES TO THIS POLICY?

In Short: Yes, we will update this policy as necessary to stay compliant with relevant laws.

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.
